Baby Bash 2014 Online Photo Contest - Official Contest Rules
These contest rules are specific to the above contest conducted by Entercom New Orleans, LLC d/b/a B97/WEZB (the “Station”). Except to the extent specifically set forth below with respect to this specific contest, the Station’s general contest rules apply to this contest as well. A copy of these specific contest rules and the Station’s general contest rules are available at the Station’s studio at 400 Poydras Street, Suite 800, New Orleans, LA, 70130 during regular business hours and on the contest page on the Station’s website at www.b97.com. To the extent that the general contest rules differ from these rules, these rules will govern and control with respect to this Contest.
HOW TO ENTER
1. No purchase is necessary to enter or win B97’s Baby Bash 2014 Online Photograph Contest (the “Contest”).
2. The contest entry period will begin at 12:00am (CT) January 2, 2014 and end on the earlier of 12:00pm (CT) on January 16, 2014, or the point at which five hundred (500) entries have been received and verified (as described below).
3. Persons eighteen (18) years of age or older wishing to enter this Contest (each an “Entrant”), must go to www.b97.com and click on the graphical “Baby Bash” Contest entry link.
4. The entry/registration process will require you to either log into an existing account, or create a free account with the game administrator, UPICKEM. You may either elect the option to have your Facebook profile pre-load applicable portions of the entry form (Facebook account is not required to enter this contest), or complete the online entry/registration form by submitting the Entrant’s name, address, phone number and e-mail address. Limit one (1) registration per e-mail address and limit one (1) qualified entry per registration.
5. Click on the “Upload Photo” tab and:
a. Submit only one (1) photograph (as defined by requirements in Section 6 below) of your child, and only your child, in either the “.jpeg” or “.jpg” file format (no other formats will be accepted),
b. Enter your child’s first name, your child’s last initial, your child’s age at the time of entry, and the town/city where you live, and
c. Affirmatively check the box or “I agree” button, expressly confirming each of the following:
• Entrant represents and warrants that he/she is both eighteen (18) years of age or older and a legal Louisiana or Mississippi resident.
• Entrant represents and warrants that 1) the child depicted in the photograph is not over thirty-six (36) months old (i.e., not yet thirty-seven (37) months old) at the time of entry, and 2) other than the child, there is no other person visible in the photograph at all, no matter how far away or obscure.
• Entrant represents and warrants that they are the parent or legal guardian of the child depicted in the photograph.
• Entrant represents and warrants that he/she either owns the rights to, or has otherwise obtained permission to use, the photograph submitted with their entry.
• Entrant represents and warrants that he/she authorizes Station to post the photograph on Station’s website or social network sites or use the photograph in any other way Station sees fit.
• Entrant agrees and acknowledges that Station, all contest sponsors, and their respective affiliates, parents, employees, agents and all other related sponsors: may use the Entrant’s name, image, photograph submission, other entry materials and/or biographical information for advertising and/or promotional purposes on radio, TV broadcasts, in the newspaper, on websites and/or any other medium in connection with participation in this contest or otherwise without the payment of any additional compensation.
• Entrant understands and agrees that Station shall be the sole and exclusive owner of the photograph submitted, whether or not the photograph is selected as a winner, and entrant agrees to sign any documents requested by Station to evidence such transfer of ownership.
• By submitting a photograph in a Station contest, entrant agrees to indemnify Station should any representations and warranties made by entrant herein or in the applicable contest rules prove to be false or inaccurate.
• Entrant acknowledges and agrees that the contest rules are available to him/her at www.b97.com, that he/she has had an opportunity to review them before entering this contest, and agrees to be legally bound by the contest rules. Contest rules are also available Monday through Friday (excluding holidays) during normal business hours between 9am (CT) and 5pm (CT) at the Station’s studios located at 400 Poydras Street, Suite 800, New Orleans, LA, 70130.
6. Photo requirements:
a. For purposes of this contest, the terms “photo” or “photograph” may be used interchangeably to include, but not be limited to the inclusion of, any image that may be produced by an analog or digital camera, by an optical image scanner (or simply, “scanner”), by means of a “screen dump,” “screen capture,” “screenshot,” or “screengrab,” and/or by the digital manipulation of one or multiple photographs such as may be achieved using image editing software.
b. The photo must be uploaded in either the “.jpeg” or “.jpg” file format (no other formats will be accepted), using the method described in Section 5 above.
c. Photo entries must not contain or depict any registered trade/servicemark or other copyrighted material other than those owned or licensed by the Entrant, or the Station, or a Contest Sponsor. The foregoing is not intended to require Station to disqualify entrants who, in Station’s sole discretion, appear to be innocently wearing clothing or are in areas that just happen to contain third party logos or marks. Further, Station may, but is not obligated to pixilate/cover any trademarks/servicemarks/copyrighted materials in Station’s sole discretion.
d. Only one (1) photo may be submitted for entry in this contest 1) by any one (1) Entrant who must be both eighteen (18) years of age or older and the parent or legal guardian of the child depicted in the photo, and 2) depicting only their one (1) child who must be thirty-six (36) months old or younger (i.e., not yet thirty-seven (37) months old) as of the date of entry may be submitted for entry in this contest.
e. No person but the child entered into the contest may be depicted in any way in the photograph (not even the entrant), and by entering this Contest, the Entrant consents to use of the photograph by Station in any manner it sees fit with no compensation to the Entrant or child. Any photograph with any other person(s) depicted in it, no matter how far away or obscure, will be deemed ineligible and thereafter disqualified.
f. If applicable, the child depicted in the photo must be at least covered with a diaper, blanket, or other covering such that the “diaper area” (area that a standard diaper would cover) is not exposed.
7. Both the entering parent/legal guardian and the child must be eligible to win in this contest (other than the minimum entry age restriction with respect to the child).
8. Station will disqualify any photograph that is received from an Entrant who is not the parent or legal guardian of the baby depicted therein.
9. Station will discard multiple entries received by same Entrant in Contest, whether photograph submitted as entry is of the same or of a different child, and only the first qualified entry to be received by Station, in chronological order, from particular Entrant will be eligible for entry in Contest.
10. By entering this contest, Entrants understand and agree that Station may elect to use any entry submitted for entertainment purposes on-air and may choose to comment on, mock, poke fun at, and/or mimic any entry submitted. Entrants waive any right to make any claim against Station or any contest sponsors with respect to any comments - disparaging or otherwise - made on-air regarding such Entrant’s entry.
11. By submitting a photograph to the Station for this contest, each Entrant authorizes the Station to post such photograph to the Station’s website at www.b97.com. Station will not post all entry photographs received on the Station’s website.
12. Photograph entries must not contain any indecency, profanity or obscenity as determined by Station in its sole discretion. photograph entries must not contain or depict any registered trade/servicemark or other copyrighted material other than those owned or licensed by the entrant, the Station, or a Contest Sponsor. BY ENTERING THIS CONTEST AND SUBMITTING PHOTOGRAPH, THE ENTRANT IS REPRESENTING TO STATION THAT THE USE AND DISTRIBUTION OF SUCH PHOTOGRAPH WILL NOT VIOLATE OR INFRINGE UPON THE RIGHTS OF ANY THIRD PARTY, INCLUDING, WITHOUT LIMITATION, COPYRIGHTS OF OTHERS. By submitting a photograph, Entrants agree to indemnify Station should any representations and warranties in these contest rules prove to be false or inaccurate.
HOW TO WIN
13. The Grand Prize Winner will be determined in the following manner:
a. At approximately 5:00pm (CT) on January 16, 2014, Station will post the photographs submitted by each of the up to first five hundred (500) photographs qualified for entry in this contest online at the Station’s website, www.b97.com. Listeners will then be able to vote for their favorite entry from among up the up to five hundred (500) photographs posted online as many times as they wish (subject to Station’s right to implement limits as set forth in the general contest rules) until 12:00pm (CT) on January 30, 2014. LISTENER VOTES WILL NOT BE A DETERMINING FACTOR IN THE SELECTION OF QUALIFIERS BUT MAY BE, IN STATION’S SOLE DISCRETION, ONE OF MANY FACTORS TAKEN INTO CONSIDERATION IN SELECTING QUALIFIERS.
i. On or about 4:30pm (CT) on January 30, 2014, up to two hundred fifty (250) entries (each a “Qualifier”) will be selected by Station staff and/or management from among all entries received to continue to the next round of the contest, based on evaluation of the submitted photograph(s) (in their subjective opinion) and/or any other any lawful criteria Station judges deem desirable.
ii. In the event that the Station receives fewer than two hundred fifty one (251) entries, this first voting round will not end as scheduled but will continue until the end of the next scheduled voting week in which the planned remaining number of Qualifiers is below the original total. For example, if two hundred twenty five (225) Qualifiers are verified by 5:00pm (CT) on January 16, 2014, voting on such Qualifiers will continue until 12:00pm (CT) on February 13, 2014 and one hundred (100) Qualifiers will continue in the contest.
b. At approximately 5:00pm (CT) on January 30, 2014, Station will post the photographs submitted by each of the two hundred fifty (250) selected Qualifiers to continue in Contest online at the Station’s website at www.b97.com. Listeners will then be able to vote for their favorite entry from among that contest period’s Qualifiers then posted online as set forth above in Section 14(a) of these rules (i.e. voting will not be determinative) until 12:00pm (CT) on February 13, 2014.
i. On or about 4:30pm (CT) on February 13, 2014, up to one hundred (100) Qualifiers selected by Station will continue to the next round of the contest based on any lawful criteria Station judges deems desirable as set forth above in Section 14(a)(i) of these contest rules.
c. At approximately 5:00pm (CT) on February 13, 2014, Station will post the photographs submitted by each of the remaining one hundred (100) selected Qualifiers online at the Station’s website at www.b97.com. Listeners will then be able to vote for their favorite entry from among that contest period’s Qualifiers online as set forth above in Section 14(a) of these rules (i.e. voting will not be determinative) until 12:00pm (CT) on February 27, 2014.
i. On or about 4:30pm (CT) on February 27, 2014, up to fifty (50) Qualifiers selected by Station will continue to the next round of the contest based on any lawful criteria Station judges deems desirable as set forth above in Section 14(a)(i) of these contest rules.
d. At approximately 5:00pm (CT) on February 27, 2014, Station will post the photographs submitted by each of the remaining fifty (50) selected Qualifiers online at the Station’s website at www.b97.com. Listeners will then be able to vote for their favorite entry from among that contest period’s Qualifiers online as set forth above in Section 14(a) of these rules (i.e. voting will not be determinative) until 12:00pm (CT) March 13, 2014.
i. On or about 4:30pm (CT) on March 13, 2014, up to ten (10) Qualifiers selected by Station will continue to the next round of the contest based on any lawful criteria Station judges deems desirable as set forth above in Section 14(a)(i) of these contest rules.
e. At approximately 5:00pm (CT) on March 13, 2014, Station will post the photographs submitted by each of the remaining ten (10) selected Qualifiers online at the Station’s website at www.b97.com. Listeners will then be able to vote for their favorite entry from among that contest period’s Qualifiers online as set forth above in Section 14(a) of these rules (i.e. voting will not be determinative) until 12:00pm (CT) March 28, 2014.
14. After 12:00pm (CT) on March 28, 2014, Station staff and/or management will select the potential grand prize winner from among the final ten (10) qualifiers, based on evaluation of the submitted photograph (in their subjective opinion) and/or any other any lawful criteria Station judges deem desirable, subject to verification of eligibility and compliance with these contest rules. Station judges may take the number of votes received into consideration (but is not obligated to) but voting will not be a determining factor in the selection of the winner.
15. Station will announce the name of the one (1) grand prize winner of Contest on air at approximately 5:00pm (CT) on March 28, 2014. The potential grand prize winner need not listen in order to win. Station will contact the potential grand prize winner. Should the potential grand prize winner not meet the eligibility requirements or is disqualified for any other reason, an alternate grand prize winner may be selected by Station, but in the event such alternate grand prize winner does not meet eligibility requirements or is disqualified, no grand prize will be awarded in this Contest.
PRIZES
16. Station will only award one (1) grand prize in this contest. The grand prize is valued at approximately $2550.00 and consists of the following:
• $1,000, payable by company check issued to verified grand prize winner only, and available within eight (8) weeks of Station’s receipt of all required completed and signed documents
• One (1) 16GB Apple iPad Air w/Wi-Fi valued at $550
• One (1) LeapFrog LeapPad Ultra Kid’s Tablet w/Wi-Fi, gel skin, car adapter, and three (3) additional learning games, all valued at approximately $250
• Two (2) $250 Target gift cards, each valid toward the purchase of merchandise and services other than the purchase of any other gift or pre-paid card(s), at Target stores in the United States and at Target.com, not redeemable for cash, will not be replaced if lost, stolen, or damaged
• One (1) $250 Clearview Mall gift card redeemable through February 2021 at participating stores and restaurants at Clearview Mall only, subject to both monthly fee of $2.50 to be deducted from the card balance on the first day of each month that follows a period of one (1) year with no activity by the card holder that results in a change in card balance and $5.00 fee to replace lost, stolen, or damaged gift card
17. The one (1) grand prize in this contest will be awarded to the Entrant only who has been both selected and verified as the grand prize winner in this contest. The child pictured is not entitled to win any prizes in this contest.
SPONSORS
18. The sponsors of this contest are Cox Communications, Clearview Mall, Toyota of Slidell, Metro PCS, Olive Branch Café, Interscope Geffen A&M, and Entercom New Orleans, LLC.
OTHER RULES
19. In order to receive the Grand Prize, the Grand Prize Winner will be required to produce documentation (including but not limited to a birth certificate or court order appointing a legal guardian) establishing that (i) they are the parent or legal guardian of the child depicted in the selected photograph; and (ii) the depicted child meets the Age Requirement. Grand Prize Winner must present the required documentation in person at Station’s studios at 400 Poydras, Suite 800 New Orleans, LA, 70130 when picking up Grand Prize.
20. Station is conducting this contest using proprietary software owned by a third party known as Second Street Media Inc. (“UPICKEM”). UPICKEM is not a sponsor of this contest but entrants may be required, as part of the entry process, to agree and consent to UPICKEM’s Terms of Service and Privacy Policy (both of which are available via a link during the contest entry process) (collectively, the “UPICKEM Policies”) and may be required to register with UPICKEM. While agreement to the UPICKEM Policies is required in order to enter this contest, the UPICKEM Policies are not a part of these contest rules but are a separate agreement between the entrant and UPICKEM. With respect to the conduct of this contest by Station, in the event of any conflict between the UPICKEM Policies and the Station contest rules, the Station’s contest rules govern.
21. Station is not responsible for any error or technical malfunctions associated with the UPICKEM site that may affect any entrant’s ability to enter, to win, or to be properly considered in this Contest, regardless of the cause. In the event of a malfunction associated with the UPICKEM site that Station (in its sole discretion) deems to materially and adversely affect this Contest, Station reserves the right to suspend this contest, terminate this contest without a winner, terminate this contest and select a winner early, provide alternative means of entry or any other changes to these contest rules that Station deems appropriate under the circumstances. Any such changes, terminations or suspensions will be announced on air and/or posted on the Station’s website, if applicable.
22. Employees of UPICKEM and its affiliates, their respective parents, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible to win in this Contest.
