Baby Bash 2017 Online Photo Contest - Official Contest Rules
These contest rules are specific to the above contest conducted by Entercom New Orleans, LLC d/b/a B97/WEZB (the “Station”). Except to the extent specifically set forth below with respect to this specific contest, the Station’s general contest rules apply to this contest as well. A copy of these specific contest rules and the Station’s general contest rules are available at the Station’s studio at 400 Poydras Street, Suite 800, New Orleans, LA, 70130 during regular business hours and on the Station’s website at www.b97.com/rules. To the extent that the general contest rules differ from these rules, these rules will govern and control with respect to this Contest.
HOW TO ENTER
1.No purchase is necessary to enter or win B97’s Baby Bash 2017 Online Photo Contest (the “Contest”).
2.The contest entry period will begin at 12:00am (CT) January 23, 2017, and end at the earlier of either 12:00pm (CT) on February 3, 2017 or the point at which five hundred (500) entries have been received and verified (as described below).
3.Persons eighteen (18) years of age or older wishing to enter this Contest (each an “Entrant”), must go to www.b97.com, and click on the graphical “Baby Bash” Contest entry link.
4.The entry/registration process may require you to either log into an existing account, or create a free account with the game administrator, UPICKEM. You may either elect the option to have your Facebook profile pre-load applicable portions of the entry form (Facebook account is not required to enter this contest), or complete the online entry/registration form by submitting the Entrant’s full name, address of legal residence, phone number (including area code), age, username (subject to acceptance by contest software to eliminate duplicate usernames), password, e-mail address, and other information requested (some of which may be optional).
a.Limit one (1) UPICKEM account per email address. Limit one (1) entry per UPICKEM account.
b.As part of the entry process, Entrants may be provided with an opportunity to opt-in to receive solicitations from, and/or to become a member/participate in clubs of (i.e., email clubs, text clubs, and rewards programs), the Station; provided, however, agreeing to receive such solicitations and/or accepting such membership is not a condition of entry into this contest and will not increase your chances of winning.
5.Click on either the “Upload Photo” or “Enter” tab and:
a.Submit only one (1) photograph (as defined by requirements in Section 6 below) of your child, and only your child, in either the “.jpeg” or “.jpg” file format (no other formats will be accepted);
b.Enter the first name, last initial, and age at the time of entry of your one (1) child depicted in the photo, as well as the town/city where you live; and
c.Affirmatively check the box or “I agree” button, expressly confirming each of the following:
•Entrant represents and warrants that he/she is both eighteen (18) years of age or older and a legal Louisiana or Mississippi resident.
•Entrant represents and warrants that 1) the child depicted in the photograph is not over thirty-six (36) months old (i.e., not yet thirty-seven (37) months old) at the time of entry, and 2) other than the child, there is no other person visible in the photograph at all, no matter how far away or obscure.
•Entrant represents and warrants that they are the parent or legal guardian of the child depicted in the photograph.
•Entrant represents and warrants that he/she either owns the rights to, or has otherwise obtained permission to use, the photograph submitted with their entry.
•Entrant represents and warrants to Station that the use and distribution of such photograph will not violate or infringe upon the rights of any third party, including, without limitation, copyrights of others in or to the picture.
•Entrant represents and warrants that he/she authorizes Station to post the photograph on Station’s website and/or on social media sites, or use the photograph in any other manner Station sees fit with no compensation to the Entrant or child.
•Entrant agrees and acknowledges that Station, all contest sponsors, and their respective affiliates, parents, employees, agents and all other related sponsors may use the name, image, photograph submission, other entry materials and/or biographical information of the Entrant and/or the Entrant’s child for advertising and/or promotional purposes on radio, TV broadcasts, in the newspaper, on websites and/or any other medium in connection with participation in this contest or otherwise without the payment of any additional compensation to the Entrant or to the Entrant’s child.
•By submitting a photograph in a Station contest, entrant agrees to indemnify Station should any representations and warranties made by entrant herein or in the applicable contest rules prove to be false or inaccurate.
•Entrant understands and agrees that Station shall be the sole and exclusive owner of the photograph submitted, whether or not the photograph is selected as a winner, and entrant agrees to sign any documents requested by Station to evidence such transfer of ownership.
•Entrant acknowledges and agrees that the contest rules are available to him/her at www.b97.com, that he/she has had an opportunity to review them before entering this contest, and agrees to be legally bound by the contest rules. Contest rules are also available Monday through Friday (excluding holidays) during normal business hours between 9am (CT) and 5pm (CT) at the Station’s studios located at 400 Poydras Street, Suite 800, New Orleans, LA, 70130.
6.For purposes of this contest, the terms “photo” and “photograph” may be used interchangeably to include, but not be limited to the inclusion of, any image that may be produced by an analog or digital camera, by an optical image scanner (or simply, “scanner”), by means of a “screen dump,” “screen capture,” “screenshot,” or “screengrab,” and/or by the digital manipulation of one or multiple photos such as may be achieved using image editing software. The photo submitted as part of Entry for this contest must (in addition to the other requirements in these Contest rules) satisfy all of the following requirements:
a.The photo must be uploaded in either the “.jpeg” or “.jpg” file format (no other formats will be accepted), using the method described in Section 5 above.
b.Only one (1) photo may be submitted for entry in this contest 1) by any one (1) Entrant who must be both eighteen (18) years of age or older and the parent or legal guardian of the child depicted in the photo, and 2) depicting only their one (1) child who must be thirty-six (36) months old or younger (i.e., not yet thirty-seven (37) months old) as of the date of entry may be submitted for entry in this contest.
c.No person but the one (1) child entered into the contest may be depicted in the photo (no matter how far away or obscure); provided, however, that Station reserves the right to accept photos that have parts of other people visible that Station deems (in its sole discretion) is not material to the photo and such persons are completely indistinguishable (for example, a leg or finger). Further Station’s decision in this matter is final and not appealable and Station is not obligated to treat every photo identically (for example, Station may decide that in one photo a leg is not material but that a leg is in another photo). Any photo with any other person(s) depicted in it will be ineligible and disqualified, except as otherwise permitted in this Section 5(d).
d.If applicable, the child depicted in the photo must be at least covered with a diaper, blanket, or other covering such that the “diaper area” (area that a standard diaper would cover) is not exposed.
e.Entrant must exclusively own (or has obtained the a license from the copyright holder to) the copyright in the submitted photo (it cannot be “owned” in any way by any other person or company without obtaining his/her express consent to enter this contest and allow Station to use the photo as contemplated in the contest rules). BY ENTERING THIS CONTEST AND SUBMITTING PHOTOGRAPH, THE ENTRANT IS REPRESENTING TO STATION THAT THE USE AND DISTRIBUTION OF SUCH PHOTO WILL NOT VIOLATE OR INFRINGE UPON THE RIGHTS OF ANY THIRD PARTY, INCLUDING, WITHOUT LIMITATION, COPYRIGHTS OF OTHERS.
f.Photo entries (as well as any comments that may be posted to any photo entries in this contest) must not contain or convey any content that the Station determines at its sole discretion, subjectively or otherwise, (i) to be indecent, profane, obscene, explicitly sexual, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, libelous, or hateful, (ii) to be racially, ethnically, or otherwise offensive or objectionable, (iii) to encourage unlawful behavior, (iv) to contain, depict, or otherwise infringe upon the brand name(s), copyright(s), trademark(s), servicemark(s), tradename(s), logo(s), or any other intellectual property that may belong to a third party, or (v) to disclose any detailed personal, physical, contact, or otherwise confidential information that may belong to a third party. The foregoing is not intended to require Station to disqualify entrants who, in Station’s sole discretion, appear to be innocently wearing clothing or are in areas that just happen to contain third party logo(s) or mark(s). Station may, but is not obligated to pixilate/cover any trademark(s), servicemark(s), tradename(s), and/or copyrighted materials in Station’s sole discretion. Station shall not be required to make the same determination based on the foregoing for every photo and may treat each photo entry differently, in its sole discretion, even if the problematic content is similar.
7.Both the entering parent/legal guardian and the child must be eligible to win in this contest (other than the minimum entry age restriction with respect to the child).
8.Station will disqualify any photograph that is received from an Entrant who is not the parent or legal guardian of the baby depicted therein.
9.Station will discard multiple entries received by same Entrant in Contest, whether photograph submitted as entry is of the same or of a different child, and only the first qualified entry to be received by Station, in chronological order, from particular Entrant will be eligible for entry in Contest.
10.By entering this contest, Entrants understand and agree that Station may elect to use any entry submitted for entertainment purposes on-air and may choose to comment on, mock, poke fun at, and/or mimic any entry submitted. Entrants waive any right to make any claim against Station or any contest sponsors with respect to any comments - disparaging or otherwise - made on-air regarding such Entrant’s entry.
HOW TO WIN
11.The Grand Prize Winner will be determined in the following manner:
a.At approximately 5:00pm (CT) on February 3, 2017, Station will post the photographs submitted by each of the up to first five hundred (500) photographs qualified for entry in this contest online at the Station’s website, www.b97.com. Listeners and visitors to the Station’s website will then be able to vote for their favorite entry from among up the up to five hundred (500) photographs posted online as many times as they wish (subject to Station’s right to implement limits as set forth in the general contest rules) until 12:00pm (CT) on February 17, 2017. LISTENER VOTES WILL NOT BE A DETERMINING FACTOR IN THE SELECTION OF QUALIFIERS BUT MAY BE, IN STATION’S SOLE DISCRETION, ONE OF MANY FACTORS TAKEN INTO CONSIDERATION IN SELECTING QUALIFIERS.
i.On or about 4:30pm (CT) on February 17, 2017, up to two hundred fifty (250) entries (each a “Qualifier”) will be selected by Station staff and/or management from among all entries received to continue to the next round of the contest, based on evaluation of the submitted photograph(s) in their subjective opinion and/or any other any lawful criteria Station judges deem desirable.
ii.In the event that the Station receives fewer than the minimum number of top photos for any one particular round of this Contest, such voting round will not end as scheduled, but will continue until the end of the next scheduled voting round in which the planned remaining number of Qualifiers is below the original total. For example, if two hundred twenty five (225) Qualifiers are verified by 5:00pm (CT) on February 3, 2017, voting on such Qualifiers will continue until 12:00pm (CT) on March 3, 2017 and one hundred (100) Qualifiers will continue in the contest.
b.At approximately 5:00pm (CT) on February 17, 2017, Station will post the photographs submitted by each of the two hundred fifty (250) selected Qualifiers to continue in Contest online at the Station’s website at www.b97.com. Listeners will then be able to vote for their favorite entry from among that contest period’s Qualifiers then posted online as set forth above in Section 11(a) of these rules (i.e. voting will not be determinative) until 12:00pm (CT) on March 3, 2017.
i.On or about 4:30pm (CT) on March 3, 2017, up to one hundred (100) Qualifiers selected by Station will continue to the next round of the contest based on any lawful criteria Station judges deems desirable as set forth above in Section 11(a)(i) of these contest rules.
c.At approximately 5:00pm (CT) on March 3, 2017, Station will post the photographs submitted by each of the remaining one hundred (100) selected Qualifiers online at the Station’s website at www.b97.com. Listeners will then be able to vote for their favorite entry from among that contest period’s Qualifiers online as set forth above in Section 11(a) of these rules (i.e. voting will not be determinative) until 12:00pm (CT) on March 17, 2017.
i.On or about 4:30pm (CT) on March 17, 2017, up to fifty (50) Qualifiers selected by Station will continue to the next round of the contest based on any lawful criteria Station judges deems desirable as set forth above in Section 11(a)(i) of these contest rules.
d.At approximately 5:00pm (CT) on March 17, 2017, Station will post the photographs submitted by each of the remaining fifty (50) selected Qualifiers online at the Station’s website at www.b97.com. Listeners will then be able to vote for their favorite entry from among that contest period’s Qualifiers online as set forth above in Section 11(a) of these rules (i.e. voting will not be determinative) until 12:00pm (CT) March 31, 2017.
i.On or about 4:30pm (CT) on March 31, 2017, up to ten (10) Qualifiers selected by Station will continue to the next round of the contest based on any lawful criteria Station judges deems desirable as set forth above in Section 11(a)(i) of these contest rules.
e.At approximately 5:00pm (CT) on March 31, 2017, Station will post the photographs submitted by each of the remaining ten (10) selected Qualifiers online at the Station’s website at www.b97.com. Listeners will then be able to vote for their favorite entry from among that contest period’s Qualifiers online as set forth above in Section 11(a) of these rules (i.e. voting will not be determinative) until 12:00pm (CT) April 14, 2017.
12.After 12:00pm (CT) on April 14, 2017, Station staff and/or management will select the potential grand prize winner from among the final ten (10) qualifiers, based on evaluation of the submitted photograph (in their subjective opinion) and/or any other any lawful criteria Station judges deem desirable, subject to verification of eligibility and compliance with these contest rules. Station judges may take the number of votes received into consideration (but is not obligated to) but voting will not be a determining factor in the selection of the winner.
13.Station will announce the name of the one (1) grand prize winner of Contest on air at approximately 5:00pm (CT) on April 14, 2017. The potential grand prize winner need not listen in order to win. Station will contact the potential grand prize winner. Should the potential grand prize winner not meet the eligibility requirements or is disqualified for any other reason, an alternate grand prize winner may be selected by Station, but in the event such alternate grand prize winner does not meet eligibility requirements or is disqualified, no grand prize will be awarded in this Contest.
PRIZES
14.Station will only award one (1) grand prize in this contest. The grand prize is valued at approximately $2839 and consists of the following:
•Four (4) Amazon Echos, valued at $800, and courtesy of Interscope Records
•One (1) Planet Beach Spray and Spa gift card good for 6 months of unlimited Spa Service at Planet Beach Spray and Spa (Includes access to all spa services, fees may be incurred for yoga mat and towel rentals, and spray tan solution), valued at $449
•Four (4) $50 Take 5 Oil Change Gift Certificates (Additional fees for canister oil filters. Good at all 5-Minute or Take 5 locations (except Rock Hill, Spartanburg, Greenville, S.C.). Not valid with fleet discounts. Limit one coupon per vehicle. Coupon must be presented at time of service and may not be combined with other banner, coupon, discounted or other same service offers. Extra conventional oil $6/quart), total value: $200
•One (1) $250 Laser Tag of Metairie Power Play Card (redeemable for all attractions; may not be redeemed for cash; not responsible for lost stolen or damaged cards; card expires two (2) years from last date of activity; valid at Laser Tag of Baton Rouge or Metairie only)
•One (1) Kids Birthday Party for up to 15 people, to be held at the Baby Cakes Baseball stadium and consisting of: 15 tickets (adult and children), designated party area, 10 baseball inspired goodie bags, photo on field with mascot, special recognition on video board (Birthday Message), and subject to the following: must call 2 weeks ahead of time to set-up, expires September 4th 2017, and valued at approximately $320.00 (Note: Party is transferrable to siblings or family members, no blackout dates.)
•Four (4) New Orleans Baby Cakes Flexbooks, each book containing ten (10) vouchers that are each good for any game in the 2017 season, vouchers can be exchanged at the ticket office for a reserved seat to any regular season game. Subject to availability, vouchers may be used one at a time or all at once, and valued at approximately $400.00
•Six (6) tickets to attend a VIP GAME in the owner’s suite (food and beverage included), in which the grand prize winner would get to throw the first pitch, date of VIP GAME to be determined at Baby Cakes’ discretion, and valued at approximately $420.00
•Grand Prize Winner’s baby will be featured on a minimum of at least one (1) or more billboards for the Baby Cakes in and around the New Orleans metro area, and in a minimum of at least one (1) or more ads in and the June cover of Kids & Family New Orleans Guide, includes professional photoshoot at no cost to winner, and at a time and date to be determined by the New Orleans Baby Cakes. (Note: this element of Prize Package has no cash value).
15.Portions of Grand Prize have no cash value. No portion of the grand prize package may be redeemed for cash or will be replaced if lost, stolen, or damaged.
16.The one (1) grand prize in this contest will be awarded to the one (1) Entrant who has been both selected and verified as the grand prize winner in this contest. The child pictured is not entitled to win any prizes in this contest.

17.The sponsors of this contest are The New Orleans Baby Cakes, Take 5 Oil Change, Planet Beach Spray and Spa, Laser Tag of Metairie, Interscope Records, and Entercom New Orleans, LLC.
OTHER RULES SPECIFIC TO THIS CONTEST
18.In order to receive the Grand Prize, the Grand Prize Winner will be required to produce documentation (including but not limited to a birth certificate or court order appointing a legal guardian) establishing that (i) they are the parent or legal guardian of the child depicted in the selected photograph; and (ii) the depicted child meets the Age Requirement. Grand Prize Winner must present the required documentation in person at Station’s studios at 400 Poydras, Suite 800 New Orleans, LA, 70130 when picking up Grand Prize.
19.Station is conducting this contest using proprietary software owned by a third party known as Second Street Media Inc. (“UPICKEM”). UPICKEM is not a sponsor of this contest but entrants may be required, as part of the entry process, to agree and consent to UPICKEM’s Terms of Service and Privacy Policy (both of which are available via a link during the contest entry process) (collectively, the “UPICKEM Policies”) and may be required to register with UPICKEM. While agreement to the UPICKEM Policies is required in order to enter this contest, the UPICKEM Policies are not a part of these contest rules but are a separate agreement between the entrant and UPICKEM. With respect to the conduct of this contest by Station, in the event of any conflict between the UPICKEM Policies and the Station contest rules, the Station’s contest rules govern.
20.Station is not responsible for any error or technical malfunctions associated with the UPICKEM site that may affect any entrant’s ability to enter, to win, or to be properly considered in this Contest, regardless of the cause. In the event of a malfunction associated with the UPICKEM site that Station (in its sole discretion) deems to materially and adversely affect this Contest, Station reserves the right to suspend this contest, terminate this contest without a winner, terminate this contest and select a winner early, provide alternative means of entry or any other changes to these contest rules that Station deems appropriate under the circumstances. Any such changes, terminations or suspensions will be announced on air and/or posted on the Station’s website, if applicable.
21.Employees of UPICKEM and its affiliates, their respective parents, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible to win in this Contest.
