Baby Bash 2012 - Official Contest Rules

These contest rules are specific to the above contest conducted by Entercom New Orleans, LLC d/b/a WEZB-FM (“Station”). Except to the extent specifically set forth below with respect to this specific contest, the Station’s general contest rules apply to this contest as well. A copy of these specific contest rules and the Station’s general contest rules are available at the Station’s studio at 400 Poydras Street, Suite 800, New Orleans, LA, 70130 during regular business hours and on the contest page on the Station’s website at www.b97.com. To the extent that the general contest rules differ from these rules, these rules will govern and control with respect to this Contest.

HOW TO ENTER
1.No purchase is necessary to enter or win B97’s Baby Bash 2012 (“Contest”).

2.The contest entry period will begin at 12:00pm (CT) January 5, 2012 and end on the earlier of 11:59pm (CT), January 18, 2012, or the point at which five hundred (500) entries have been received and verified (as described below).

3.Persons wishing to enter the Contest (each a “Entrant”) must submit to the Station: one color photograph of their baby, their name, the baby’s name, address, email address, age (of both entrant & baby) and telephone number(s), by going to www.b97.com and clicking on the graphical “Baby Bash 2012” entry link and then uploading their photo submission and information as described above. The uploaded photo must be in either a .jpeg or .jpg file format (no other formats will be accepted). See Sections 4 through 12 below for more details about photo and other entry requirements.

4.No person but the baby entered into the contest may be depicted in any way in the photo (not even the entrant) and by entering this Contest, the Entrant consents to use of the photograph by Station in any manner it sees fit with no compensation to the Entrant or child. Any photograph with any other person(s) depicted in it will be ineligible and disqualified.

5.As a condition of entry, the entrant must affirmatively check a box or an “I agree” button expressly confirming the following:
•Entrant represents and warrants that he/she is over 18 years of age.
•Entrant represents and warrants that he/she own the rights to, or have obtained permission to use, the photo submitted with the entry.
•The child depicted in the photo is not over 36 months old at time of entry and that the submitted photo was taken no more than three (3) months prior to January 5, 2012.
•Entrant represents and warrants, 1) there is only one person visible in the attached photo, 2) the person depicted is a child not over 36 months old, and 3) the Entrant is the parent or legal guardian of the child.
•Entrant represents and warrants that he/she authorizes Station to post the photo on Station’s website or social network sites or use the photo in any other way Station sees fit.
•Entrant agrees and acknowledges that Station, Ray Brandt Toyota, Gigi’s Cupcakes, other contest sponsors, and their respective affiliates, parents, employees, agents and all other related sponsors: may use the Entrant’s name, image, photo submission, other entry materials and/or biographical information for advertising and/or promotional purposes on radio, TV broadcasts, in the newspaper, on websites and/or any other medium in connection with participation in this contest or otherwise without the payment of any additional compensation.
•Entrant understands and agrees that Station shall be the sole and exclusive owner of the photo submitted, whether or not the photo is selected as a winner, and entrant agrees to sign any documents requested by Station to evidence such transfer of ownership.
•By submitting a photo in a Station contest, entrant agrees to indemnify Station should any representations and warranties made by entrant herein or in the applicable contest rules prove to be false or inaccurate.
•Entrant acknowledges and agrees that the contest rules are available to him/her at www.b97.com, he/she has had an opportunity to review them before entering this contest and agrees to be legally bound by the contest rules. Contest rules are also available Monday through Friday (excluding holidays) during normal business hours between 9am (CT) and 5pm (CT) at the Station’s studios located at 400 Poydras Street, Suite 800, New Orleans, LA, 70130.

6.Each Entrant may submit only one (1) entry in this contest and Entrant must be the parent or legal guardian of the baby depicted in the photo. Station will disqualify any photo received from an Entrant who is not the parent or legal guardian of the baby depicted therein. Station will discard multiple entries from the same Entrant (whether containing photos of the same or of different babies) and only the first qualifying entry received will be eligible to participate.

7.The baby depicted in the submitted photo is not over 36 months old at time of entry (the “Age Requirement”) and the photo should be no more than three (3) months old, as of the date of submission. The baby depicted in the photo must be at least covered with a diaper.

8.Both the entering parent/legal guardian and the baby must be eligible to win in this contest (other than the minimum entry age restriction with respect to the child).

9.By entering this contest, Entrants understand and agree that Station may elect to use any entry submitted for entertainment purposes on-air and may choose to comment on, mock, poke fun at, and/or mimic any entry submitted. Entrants waive any right to make any claim against Station or any contest sponsors with respect to any comments - disparaging or otherwise - made on-air regarding such Entrant’s entry.

10.By submitting a photo to the Station for this contest, each Entrant authorizes the Station to post such photo to the Station’s website at www.b97.com. Station will not post all entry photos received on the Station’s website.

11.Photograph entries must not contain any indecency, profanity or obscenity as determined by Station in its sole discretion. Photograph entries must not contain or depict any registered trade/servicemark or other copyrighted material other than those owned or licensed by the entrant, the Station, or a Contest Sponsor. BY ENTERING THIS CONTEST AND SUBMITTING PHOTOGRAPH, THE ENTRANT IS REPRESENTING TO STATION THAT THE USE AND DISTRIBUTION OF SUCH PHOTOGRAPH WILL NOT VIOLATE OR INFRINGE UPON THE RIGHTS OF ANY THIRD PARTY, INCLUDING, WITHOUT LIMITATION, COPYRIGHTS OF OTHERS. By submitting a photo, Entrants agree to indemnify Station should any representations and warranties in these contest rules prove to be false or inaccurate.

HOW TO WIN
12.The Grand Prize Winner will be determined in the following manner:
i.At approximately 5pm (CT) on Thursday January 19, 2012, Station will post photos of up to the first 500 entries online at the Station’s website, www.b97.com. Listeners will then be able to vote for their favorite baby from among up the up to five hundred (500) photos posted online as many times as they wish (subject to Station’s right to implement limits as set forth in the general contest rules) until 12pm (CT) on Wednesday February 1, 2012.
ii.On or about 4:30pmCT on February 1, 2012, up to two hundred fifty (250) qualifiers will be selected by Station staff from among all entries received to continue to the next round of the contest, such selection to be based on any lawful criteria Station judges deems desirable (“Qualifiers”). LISTENER VOTES WILL NOT BE A DETERMINING FACTOR IN THE SELECTION OF QUALIFIERS BUT MAY BE, IN STATION’S SOLE DISCRETION, ONE OF MANY FACTORS TAKEN INTO CONSIDERATION IN SELECTING QUALIFIERS.
a.In the event that the Station receives fewer than two hundred and fifty one (251) entries, this first voting round will not end as scheduled but will continue until the end of the next scheduled voting week in which the planned remaining number of Qualifiers is below the original total. For example, if two hundred twenty five (225) Qualifiers are verified by 11:59pm (CT) on Wednesday January 19, 2012, voting on such Qualifiers will continue until 12:00pm (CT) on Wednesday February 15, 2012 and one hundred (100) Qualifiers will continue in the contest.
iii.At approximately 5pm (CT) on Wednesday February 1, 2012, Station will post the photos of the two hundred fifty selected (250) Qualifiers online at the Station’s website at www.b97.com. Listeners will then be able to vote for their favorite baby from among the 250 Qualifiers then posted online as set forth above in subsection (i) (i.e. voting will not be determinative) until 12pm (CT) on Wednesday February 15, 2012.
iv.On or about 4:30pmCT on February 15, 2012, up to one hundred (100) Qualifiers selected by Station will continue to the next round of the contest based on any lawful criteria Station judges deems desirable as described in subsection (ii) above.
v.At approximately 5pm (CT) on Wednesday February 15, 2012, Station will post the photos of the remaining one hundred (100) selected Qualifiers online at the Station’s website at www.b97.com. Listeners will then be able to vote for their favorite baby from among that contest period’s Qualifiers online as set forth above in subsection (i) (i.e. voting will not be determinative) until 12pm (CT) on Wednesday February 29, 2012.
vi.On or about 4:30pmCT on February 29, 2012, up to fifty (50) Qualifiers selected by Station will continue to the next round of the contest based on any lawful criteria Station judges deems desirable as described in subsection (ii) above.
vii.At approximately 5pm (CT) on Wednesday February 29, 2012, Station will post the photos of the remaining fifty (50) selected Qualifiers online at the Station’s website at www.b97.com. Listeners will then be able to vote for their favorite baby from among that contest period’s Qualifiers online as set forth above in subsection (i) (i.e. voting will not be determinative) until 12pm (CT) Wednesday March 14, 2012 at 12pm (CT).
viii.On or about 4:30pmCT on March 14, 2012, up to ten (10) Qualifiers selected by Station will continue to the next round of the contest based on any lawful criteria Station judges deems desirable as described in subsection (ii) above.
ix.At approximately 5pm (CT) on Wednesday March 14, 2012, Station will post the photos of the remaining ten (10) selected Qualifiers online at the Station’s website at www.b97.com. Listeners will then be able to vote for their favorite baby from among that contest period’s Qualifiers online as set forth above in subsection (i) (i.e. voting will not be determinative) until 12pm (CT) Friday March 30, 2012.
x.On Friday March 30, 2012, Station will select the potential Grand Prize Winner from among the final ten Qualifiers and announce his/her name on the air at approximately 5pm (CT) on Friday March 30, 2012. The potential Grand Prize Winner need not listen in order to win. Station will contact the potential Grand Prize Winner. Station will select Grand Prize Winner based on evaluation of the submitted photo (in their subjective opinion) and/or any other any lawful criteria Station judges deem desirable, subject to verification of eligibility and compliance with these contest rules. Station judges may take the number of votes received into consideration (but is not obligated to) but voting will not be a determining factor in the selection of the winner. Should the potential grand prize winner not meet the eligibility requirements or is disqualified for any other reason, an Alternate Grand Prize Winner will be selected by Station but in the event such Alternate Grand Prize Winner does not meet eligibility requirements or is disqualified, no Grand Prize will be awarded in this Contest.

PRIZES
13.Station will only award one (1) Grand Prize in this contest. The Grand Prize is valued at approximately $1185 and consists of the following:
•One (1) 16GB Apple iPad 2 w/Wi-Fi valued at $499
•Two (2) $100 Zuppardo’s Family Supermarket gift certificates, provided by Ray Brandt Toyota, valid for purchases at the Zuppardo’s Family Supermarket location at 5010 Veterans Blvd. Metairie, LA
•One (1) $50 Zuppardo’s Family Supermarket gift certificates, provided by Ray Brandt Toyota, valid for purchases at the Zuppardo’s Family Supermarket location at 5010 Veterans Blvd. Metairie, LA
•One (1) Gigi’s Cupcakes gift basket valued at $40 and containing one cooler bag, one coffee mug, one Gigi’s Cupcakes t-shirt and one aluminum water bottle
•Twelve Gigi’s Cupcakes gift certificates, not redeemable for cash. Each individual gift certificate is valued at $33 and valid for the redemption of one (1) dozen cupcakes per month from April 2012 – March 2013, only during the one (1) calendar month indicated on the certificate.

14.The sponsors of this contest are Ray Brandt Toyota, Gigi’s Cupcakes and Entercom New Orleans, LLC.

OTHER RULES
15.Entrants must be 18 years of age or older at time of entry.

16.In order to receive the Grand Prize, the Grand Prize Winner will be required to produce documentation (including but not limited to a birth certificate or court order appointing a legal guardian) establishing that (i) they are the parent or legal guardian of the baby depicted in the selected photo; and (ii) the depicted baby meets the Age Requirement. Grand Prize Winner must present the required documentation in person at Station’s studios at 400 Poydras, Suite 800 New Orleans, LA, 70130 when picking up Grand Prize.
